The "pornube" name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks of pornube or its affiliates or licensors. You must not use such marks without the prior written permission of pornube.

You retain ownership of any User Content you submit, post, or display on or through the Services. However, by submitting User Content, you grant pornube a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and pornube's business, including for promoting and redistributing part or all of the Services.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the license above and that your User Content does not infringe any third-party intellectual property rights.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall pornube, its affiliates, directors, employees, licensors, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

In no event shall pornube's total liability to you for all claims arising from or related to the Services exceed the amount you have paid to pornube, if any, in the past six months, or one hundred dollars ($100), whichever is greater.

PORNUBE MAKES NO WARRANTY THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

Any material downloaded or otherwise obtained through the use of the Services is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

7. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal or state courts located in Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
